A CLASS ACTION OR REPRESENTATIVE ACTION OR YOUR RIGHT TO PARTICIPATE IN A REPRESENTATIVE OR CLASS PROCEEDING WITH RESPECT TO A CLAIM IS WAIVED BY BOTH YOU AND DR IJAZ ALAM LTD. Other rights that you might have in court, such access to discovery, could not be available in arbitration or might be severely restricted.

Any dispute arising from or relating to these Terms of Use and their interpretation or the breach, termination, or validity thereof, the relationships which result from these Terms of Use, including disputes regarding the validity, scope, or enforceability of this arbitration provision, between you and DR IJAZ ALAM LTD, its agents, employees, officers, directors, principals, successors, assigns, subsidiaries, or affiliates (collectively for purposes of this section, DR IJAZ ALAM LTD) The initiating party shall send the other party written notice of its plan to file for arbitration at least 60 days prior to the commencement of any arbitration. You must send this notification by mail or email to DR IJAZ ALAM LTD's general counsel as specified below. DR IJAZ ALAM LTD will send this notice to the email address on its records for you.

The parties will make an effort to amicably resolve any Covered Disputes through amicable conversations during this 60-day notice period. After the notice period has passed and no such amicable settlement has been reached, either party may request arbitration. Unless you or DR IJAZ ALAM LTD request and the arbitrator approves of in-person attendance, the arbitrator will conduct any arbitration proceedings by telephone or videoconference. Any in-person meetings will take place at a place jointly chosen by you and DR IJAZ ALAM LTD, or if there is no such agreement, at a place chosen by the arbitrator. Any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgement in any court of competent jurisdiction. The arbitrator shall have the authority to grant any relief that would be available in court under law or in equity. The terms of these Terms of Use and applicable legislation shall be applied by the arbitrator, and failing to do so shall be constituted an abuse of the arbitrator's powers and a basis for judicial review. You and DR IJAZ ALAM LTD acknowledge and agree that any Covered Dispute shall be arbitrated alone on an individual basis.

The arbitrator(s) will not have the right to arbitrate any Covered Dispute on the basis of a class, representative, or private attorney general basis, and neither DR IJAZ ALAM LTD nor you are allowed to do so. The other arbitration terms will remain completely valid, binding, and enforceable even if any part of the agreement to arbitrate in this section is found to be unlawful or unenforceable (but in no case will there be a class, representative or private attorney general arbitration). The Federal Arbitration Act, 9 U.S.C. sec. 1-16 (FAA), and, where otherwise relevant, British law, will govern these terms of use and any transactions relating to them.
